Aqal Realty provides a digital platform where licensed real estate agencies and their agents can list, promote, and manage properties for sale or rent across the East African region. Acting as a Multi-Listing Service (MLS), we connect real estate professionals with prospective buyers, renters, or investors.
Eligibility
To use Aqal Realty:
• You must be at least 18 years old.
• You must be legally authorized to represent a real estate agency or act as an agent.
• You must comply with all applicable local, national, and international laws and regulations.
• We reserve the right to verify your identity and credentials.
User Accounts
To access listing services, you must create an account by providing accurate and complete information. By registering, you agree to:
• Maintain the confidentiality of your login credentials.
• Accept responsibility for all activities under your account.
• Notify us immediately of any unauthorized use or breach.
• We reserve the right to suspend or terminate accounts that violate these Terms.
Listing Properties
By submitting a property listing, you represent and warrant that:
• You have the legal right and authority to list the property.
• The information provided is truthful, accurate, and up-to-date.
• You will update or remove listings that are no longer available.
• Aqal Realty reserves the right to reject or remove any listing that violates our guidelines, is misleading, or is deemed inappropriate.
Listing Fees and Payments
Listing properties on Aqal Realty requires payment of applicable fees.
• All fees are stated in [Insert Currency] and are non-refundable unless otherwise specified.
• Payments must be made through approved payment methods on the platform.
• We reserve the right to update pricing, introduce premium features, or modify payment terms at any time with prior notice.
Prohibited Conduct
You agree NOT to:
• Post false, misleading, or fraudulent listings.
• Impersonate another person or agency.
• Use automated tools to scrape or collect data from the site.
• Violate local housing or anti-discrimination laws.
• Upload harmful software, viruses, or malware.
• Interfere with the security or functionality of our platform.
Violations may result in account suspension, listing removal, and legal action.
Intellectual Property
All content, trademarks, and materials on the platform—including logos, graphics, and code—are the property of Aqal Realty or its licensors. You may not copy, modify, distribute, or reproduce any part of the platform without prior written permission.
Platform Availability
While we strive to provide uninterrupted access, we do not guarantee that the platform will always be available or error-free. We may perform maintenance, upgrades, or discontinue certain features at our discretion.
Third-Party Services
Aqal Realty may integrate or link to third-party tools or websites. We are not responsible for their content, functionality, or practices. Your use of third-party services is at your own risk and subject to their terms and privacy policies.
Limitation of Liability
Aqal Realty is not responsible for:
• The accuracy or legality of listings posted by users.
• Any transaction or dispute between users and third parties.
• Loss or damage caused by unauthorized access to your account.
• Technical issues, system errors, or service interruptions.
Our maximum liability to you shall not exceed the amount you paid for services in the 3 months prior to the event giving rise to the claim.
Disclaimer
Aqal Realty provides its services on an “as is” and “as available” basis. We do not guarantee that the platform will meet your expectations or that property sales or leases will result from listings.
Termination
We may suspend or terminate your account at any time for violating these Terms or applicable laws. You may also terminate your account at any time by contacting us. Termination does not entitle you to a refund of listing fees already paid.
Governing Law
These Terms are governed by the laws of Minnesota, without regard to its conflict of laws principles. Disputes shall be resolved in the competent courts of Minnesota.
Changes to the Terms
We may update these Terms from time to time. You will be notified of any material changes through the platform or by email. Your continued use of the platform after such changes constitutes your acceptance of the new Terms.
